This Policy sets out when and how we use your personal information. It describes the types of information we may collect from you (“you”, “your” or the “User”) or that you may provide while using or purchasing any of our products (“Product”) and/or the website of the Company (“Website“), and its storage, usage, processing and disclosure.
You hereby acknowledge and confirm that this Policy and the Terms of Service shall apply to you as well as to any organization or company that accesses or uses our Products or services through you (each a “Customer”).
Nymble shall follow these principles when it comes to the User’s privacy:
(i) Personal information isn’t collected unless it is required to be collected to either provide the services or for compliance with the law.
(iii) Other non-personal/non-identifiable information is collected to optimize our Services and keep a record of your experience of using our Products.
(iv) Any personally identifiable information about you or the User is stored by us is encrypted and anonymized for storage in our servers and is never shared with any third party in personally identifiable Form unless compelled by a governmental or juridical or quasi-judicial authority to do so in writing by way of an order or a warrant.
1. Information Collected and manner of collection
1.1 We collect information from and regarding Users, their affiliates, employees and their Customers, including the following information:
(a) Information by which each of the User’s affiliate, employees and Customers may be personally identified, such as name and e-mail address or any other information input which the Company collects during the use of the Website or while purchasing Products online, by the User which may be defined as personal or Personally Identifiable Information (“PII”) under applicable law.
(b) Records and copies of the User’s correspondence (including e-mail addresses) with us. The User’s statistics, queries and its last IP address, in the event that a User encounters a problem or technical difficulty while using our Product.
(c) Information collected when the User interacts with Nymble’s personnel for any purpose, including reporting a problem with or difficulty using our Product. In addition, the collection and processing of the collected information is automatic as the User accesses the Website (including usage details, IP addresses and other information obtained through Google Analytics or other such tracking technologies).
1.2 You hereby acknowledge and confirm that:
(b) you are not infringing any copyright by providing us with this information;
(c) the information is authentic and verified by you;
(d) you are not a child below the age of 18 years, of a legal age and of sound mind to comprehend the policy and to enter into a contract;
PII, collected during User’s use of the Website and information collected during interactions with Nymble personnel shall be hereinafter collectively referred to as “Information” or “Data”.
1.4 Nymble shall not be responsible or liable with respect to the authenticity of such Information.
2. Protection of Data
Nymble undertakes the following steps to protect your Data:
(a) PII shall be collected and stored and secured by means of encryption. PII so stored shall be reasonably and appropriately secured with respect to industry standards.
(b) All Information collected and stored shall be protected, secured and anonymized to ensure that it is in non-identifiable form.
(c) The security procedures, practices and other security protocols are regularly updated to comply with industry standards. By continuing to use the Website, you accept that there might be breaches and cases of unauthorized access to your Data. You hereby accept the risk and any potential liability due to any such breach, misuse, appropriation or loss and agree you shall not hold Nymble responsible or liable in such an event. Nymble disclaims any warranty of absolute protection of Data from breach, misuse, misappropriation or loss to the fullest extent provided by law.
(d) Data may be disclosed in the event of an investigation or otherwise mandated by any Government authority or agency, or to protect Nymble’s own interest such as prevention of any kind of fraud, or in case of detected copyright or intellectual property right infringement or other related reasons.
(e) The geographical location of the Data stored shall be subject to the location of the third-party storage provider, whose services are availed by Nymble. The Data may not be stored locally. The location of such servers may be in international territory or foreign countries.
(f) Any Data and Information shall not be provided to any third party except for the processes required to give effect to the services and to improve or expand upon the services provided.
3. Third Parties and Third-Party access to Data
3.2 Nymble may collaborate with third parties and third-party platforms in order to provide products, services or links in association with third parties. You hereby provide consent to Nymble to share your Data with such third parties and abide by the terms and conditions as stipulated by such third parties.
3.3 Online purchases on Nymble may require you to enter your payment details and information with the third-party host of a payment gateway. You agree that any such Data provided to such a third-party host is at your own risk and Nymble shall not be liable in any manner for any loss or breach of data caused due usage of such payment gateway.
3.4 In the event of sale of any Nymble asset or resource, or any other department functioning under it to an external buyer or third party, your data may be transferred to such an entity.
3.5 While any such affiliation shall require the third parties to safeguard and protect the Data and maintain confidentiality, Nymble shall not be responsible for any compliance or breach on part of the third-party organisation beyond reasonable due diligence carried out by Nymble.
3.6 Nymble shall not be responsible or under any obligation for any loss of Data or Information, or any Information breach that occurs due to any action, negligence or omission on part of such third parties or third-party platforms.
4. Usage by Children
4.1 Any child under the age of 18 are not allowed to register or avail any services on the Nymble website, or browse or use the website. Nymble shall not knowingly or intentionally ask for any information or request Data from any child below the age of 18 years.
4.2 In the event you wish to notify us about your child or any other child using a Nymble service without authorization, parental guidance or supervision, you may notify the Grievance Officer using the details provided and as defined in clause 10 (Grievance Officer) below.
5. Cookies and IP Address
5.2 A cookie is a small file of letters and numbers that we store on your browser or the hard drive of your computer. Only non-essential, non-identifiable files are stored in the form of cookies and only after you have given consent on the Website.
5.3 Cookies may be blocked by activating the setting on your browser that allows you to refuse the setting of all or some cookies. However, if you use your browser settings to block all cookies (including essential cookies) you may not be able to access all or parts of our site.
5.4 An IP Address is a set of numbers that is assigned to your system on accessing the internet. Nymble gets access to your IP Address when you use the Website and Nymble may retain logs and information pertaining to your IP Address.
You hereby agree to indemnify and hold harmless Nymble, including legal costs incurred, for any dispute, claims, demands, damages, penal or legal action initiated by a third party for any loss or breach caused by your actions and/or for the violation of this Policy.
7. Limitation of Liability
7.1 In the event of a breach or loss of data that is directly and exclusively attributable to Nymble, Nymble shall be liable to pay only an amount of compensation limited to and to the extent of the maximum retail price of the Product.
8. Governing Law and Dispute Resolution
8.2 Dispute Resolution: Disputes may be referred to arbitration, and the rules and procedures shall be determined by the parties to the arbitration. A sole arbitrator may be appointed within thirty days of notice of such dispute, and in the event such an appointment fails, both parties shall nominate one arbitrator who shall further nominate and appoint a third arbitrator to preside over a tribunal so appointed. The decision of the arbitral panel shall be final and binding, and shall be placed on record as a judgement in the competent court having relevant jurisdiction.
